Services Agreement
By contracting any of the services offered by Long, you agree to be bound by this Services Agreement as of the date payment is made, entered into between Carol Elizabeth Long (“Long”) and you, (each, a “Party,” and collectively the “Parties”).

1. Services. Long is an animal communicator and teacher, who provides individual sessions, courses, coaching and mentoring for individuals concerning their animals (the “Services”). This agreement applies to the any of the Services you choose Long to perform for you:
- Individual Sessions (i.e., connecting telepathically with your animal, creating a transcript of the conversation for you. Some subjects covered are bonding on a deeper level, deep-seated problematic behavior, aligning your personal and spiritual growth with your animal's and grieving humans as animals crossing over)
- Basic Animal Communication (i.e., a course covering the process of Animal Communication and related topics, your own starting point and how to develop further).
- Intermediate Animal Communication Course (i.e., a how-to course on managing situations that humans and animals can present including illness, behavior modification and more as well as how to structure and present findings successfully to others. Please note that to take this course, you must already have completed the Basic Animal Communication Course).
-Animal Communication Topic Classes (i.e., short classes, which explore one area of animal communication in depth, such as working with your own animals, trauma healing, travel or moving itinerary. Please note that to take this course, you must already have completed the Intermediate Animal Communication Course).
- Earth Mystery Schools Courses, Coaching & Mentoring (i.e., Universal Teachings based on Animals' Guidance; discerning and learning how communication works from a larger perspective as Long works with you to dig deeper into what your animals convey, and the intimacy of your relationships and how they relate to Universal Communication. Long draws upon decades of visual language and metaphysical studies to help you align with inherent Universal and animal knowledge over successive 4-week periods and standalone classes. Please note that to take these courses, you must have already completed the Basic Animal Communication Course.

2. Payment. The Services in Section 1 shall not commence until full payment of such Services is paid by you. Any payment delay beyond two weeks after engaging Long's services shall result in termination of this Agreement. ALL SALES ARE FINAL. NO REFUNDS.

3. Copyright Ownership. Long shall own the copyright in and to any transcripts, classes, videos, books, workbooks, journals, coloring books, podcasts, audio clips, and merchandise that Long creates based on any communications she has with your animals, whether the content is created in print, electronic, digital, audio, video, or any other form or format now known or hereafter discovered or created. You further acknowledge that Long has the right to create derivative works therefrom.

4. Disclaimer: THIS [COURSE/VIDEO/COACHING SESSION/ANIMAL COMMUNICATION SESSIONS] IS FOR ENTERTAINMENT PURPOSES ONLY AND CONTAINS INFORMATION ABOUT THE SPIRITUAL WORLD. LONG IS NOT A LICENSED PROFESSIONAL AND THE INFORMATION YOU MAY [LEARN/WATCH] FROM SUCH [COURSE/VIDEO/COACHING SESSION/ANIMAL COMMUNICATION SESSION] SHOULD NOT BE TREATED AS A SUBSTITUTE FOR, NOR DOES IT REPLACE ANY PROFESSIONAL ADVICE (I.E., MEDICAL, PSYCHOLOGICAL, FINANCIAL, OR LEGAL ADVICE), DIAGNOSIS, TREATMENT, OR THE LIKE. IF YOU HAVE ANY CONCERNS OR QUESTIONS ABOUT YOUR ANIMAL, YOU SHOULD CONSULT WITH A VETERINARIAN OR OTHER HEALTHCARE PROFESSIONAL (OR OTHER APPLICABLE PROFESSIONAL). LONG IS NOT RESPONSIBLE FOR ANY ERRORS OR OMISSIONS OR ANY CONSEQUENCES FROM APPLYING THE INFORMATION YOU OBTAIN IN THE [COURSE/VIDEO/COACHING SESSION] AND MAKES NO WARRANTY, EXPRESS OR IMPLIED, WRITTEN OR ORAL, WITH RESPECT TO THE CURRENCY, COMPLETENESS, OR ACCURACY OF THE SERVICES. YOU ARE ADVISED TO TAKE FULL RESPONSIBILITY FOR YOUR OWN SAFETY AND YOUR ANIMAL’S SAFETY.
5. Representation and Warranty. You represent and warrant that you are at least 18-years-old and have the ability to enter into this Agreement.

6. Confidentiality. The terms and conditions of this Agreement are confidential between the Parties and shall not be disclosed to anyone else, except as mutually approved by the Parties, or as required by law.
7. Limitation of Liability. In no event shall Long be liable for consequential, indirect, incidental, special, exemplary, punitive, lost profits or revenues or diminution of value arising out of, relating to, or in connection with any breach of this Agreement, regardless of whether such damages were foreseeable, whether or not Long was advised of the possibility of such damages, and the legal or equitable theory (contract, tort, or otherwise) upon which the claim is based. Long’s liability at common law under this Agreement is limited to the value of the Services under Section 1 of this Agreement.
8. Privacy. Your personally identifiable information (e.g., name, address, email address, pet’s name, address, location, etc.). shall not be shared with any third-parties, unless required by law. Moreover, any use of the transcripts by Long shall deidentify the Parties and protect their privacy (e.g., changing the Parties’ names, physical characteristics of individuals, locations, etc.).

9. Termination. The Parties may terminate this Agreement upon thirty (30) days prior notice if the Parties fail to perform or otherwise breach any of their obligations under this Agreement, and the Party receiving such termination notice has not cured such failure or breach within thirty (30) days.

10. Survival. Sections 3-8, 13, 14 shall survive the termination or expiration of the Agreement.
11. Assignment: Due to the personal services nature of this Agreement, neither Party may assign the rights, duties, and obligations under this Agreement.

12. Force Majeure: The Parties shall not be liable for any failure of or delay in the performance of this Agreement for the period that such failure or delay is due to causes beyond their reasonable control, including but not limited to, acts of God, war, pandemics, strikes or labor disputes, embargoes, government orders or any other force majeure event.

13. Governing Law: The Parties agree that the Agreement is to be governed by and construed under the laws of the State of New York without regard to its conflicts of law provisions.
​
14. Arbitration: Any controversy or claim arising out of or relating to the Agreement shall be settled by arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration hearing shall take place in New York, New York before a single arbitrator.
15. Headings The headings in the Agreement are for convenience of reference only, are not part of the Agreement, and shall not affect the Agreement.
16. Severability: If any provision of the Agreement is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of the Agreement shall remain operative and binding on the Parties.
17. Entire Agreement: This Agreement constitutes the entire agreement between the Parties concerning its subject matter and supersedes any and all prior agreements, arrangements or understandings (whether written or oral) relating hereto. No addition or modification of any provision of this Agreement shall be binding upon the Parties unless in writing and signed by the Parties.
18. You have entered this Agreement by checking the 'I Agree to the Terms & Conditions' on the payment form, and by making payment, dating your agreement at the time and on the date of payment submission.

Privacy Policy
Carol Elizabeth Long (“Long”) is committed to protecting your privacy. You may be asked to provide certain personal information, such as your name, email address, phone number, and address, when registering for a consultation on the Long’s website, which the Long collects and stores. Long uses the information that it collects and stores about you to help Long better improve the website and provide for a more personalized service. Long does not enable “cookies” on its website. Long does not share any personally identifiable information provided by visitors of Long’s website to third-parties. However, Long may release your personally identifiable information when required by law. Unless prevented by law, Long will notify you prior to the release of such information. This Privacy Policy does not apply to third-party websites that may be accessible though Long’s website.

This privacy notice (“Notice”) describes how Carol Elizabeth Long (collectively, “Long”, “we”, “us” and “our”) collect, use and share personal information about California residents in and their rights with respect to that information.
